Résumé
This article analyze ineffective policies «Zero Tolerance» taken against drugs which do not pose great risks to health. From a perspective of Criminal Policy, is proposed the posibility of adopting of a policy that legalise certain drugs such as Uruguay, Colorado and Whashington, which are more respectful of individual freedom and the constitutional principle of the free development of personality . In contrast to State Paternalism. From this point, as could not be otherwise, from a conception of Minimum Criminal Law, of Ultima Ratio, in the frame-work of the Social and Democratic of Rule of Law
