The mechanism of sale of productive unit known as Prepack is postulated as the definitive solution for the evils that afflict the bankruptcy procedure, The Court of First Instance found that the Court of First Instance had not provided an attractive outlet for all the assets that had come to it in insolvency. Given the current paralysis decreed by the Government -until December 31, 2021- of any request for voluntary and necessary tender, it is time to analyze if the structure of sale designed with the Pre Pack conforms to our bankruptcy law and especially if this can end up being the formula that converts definitively the bankruptcy procedure into an effective mechanism that guarantees the continuity of those companies in insolvency that go to it.
