Abstract

The purpose of this study is to analyze the militia phenomenon in Brazil, aiming to create a newcriminological category that best fits the Brazilian reality. In the first moment it is conceptualizedwhat militias are, who are the agents involved and the consequences for the dominatedcommunity, in an attempt to demonstrate the origin of these groups. Furthermore, militias and thecriminological categories of white-collar crime and organized crime are confronted, in order topunctuate aspects regarding the modus operandi and the characters involved in these groups, toconstruct the concept of the militia. Moreover, it is analyzed how the militias, due to their origin,threaten the Social Democratic State of Law and put in check the egalitarian criminal persecution.Finally, the work aims to find possible solutions to the problematic that involves this newcriminological category, such as the demilitarization of the police and the change in the legaltreatment of drugs
