Resumen

Due to insufficient visualization from the legal matter in some consulted investigations, it is intended to make a critical reflection of the care and prevention of gender violence in the Cuban legal system. We started from a dialectical- materialist general approach praising the use of a fundamentally qualitative methodology, from the theoretical field to its approach in the legal one as well as establishing the gaps, policies, rules and laws remaining lacking of progress. The results serve to warn, prevent and document the society around the social dangerousness forms of violence against women that constitute crimes, object of controlling , loss of self esteem as subject, and the need to design the critical path of care and prevention of domestic violence.
