Abstract

The only legal reference that appears in article 348.2 of the Civil Code grants ownership claims to the owner. For this reason, case-law development is crucial in this matter. This study attempts to gather all previous case-law criteria. Basically, the claim is delimited with respect to similar ones, its requirements are defined, with special emphasis on the proof of ownership and procedural aspects such as legitimacy, effects or pre-registration of the claim and grounds for irrepleviability.
