Abstract

In view of the recent provisional sanction by the UEFA to Manchester City Football Club for violating the rules on financial fair play (FFP), and in the context of the market economy where football clubs undoubtedly are located, it is pertinent to ask ourselves whether said regulatory infraction is also constitutive of an act of unfair competition. Specifically, an act of violation of regulations provided for in article 15 of the Unfair Competition Law. And, secondly, if such infringement also constitutes an illicit antitrust of distortion of free competition for unfair acts, regulated in article 3 of the Competition Defense Law. The present work starts from analyzing UEFA’s private regulations on the FFP, as well as the aforementioned potentially violated legal provisions, to end with a series of final considerations
