Resum
Gender equality represents one of the seventeen goals of the 2030 Agenda for Sustainable Development without which it is not possible to implement the universal plan of action aimed at protecting the planet, strengthening universal peace, guaranteeing shared prosperity and ensuring the personal development of all human beings in dignity and equality. However, serious situations of inequality still persist in societies and the Law does not remain oblivious to this social context as it is permeated by the same oppressive logics and narratives of domination that govern the structure of life, perpetuating the discrimination that already exists in the social discourse, and therefore also gender stereotypes. In this way, the main objective of this paper is to critically analyse the specific situation of the victim of gendered violence in the Spanish criminal justice system, and to make proposals to give visibility to the real will of the victim and to take it into account through the emancipatory character presupposed by Law as an instrument of change, due to its ambivalent nature of conformity and subversion of the narratives of domination.
