Dossier jurisprudencial sobre propiedad intelectual

Abstract

2023 has not been a particularly prolific or important year in terms of judicial decisions on intellectual property. The majority of rulings of the Supreme Court and the Provincial Courts ratify existing jurisprudential lines on originality, value of the intellectual property registry, rights acquired or transmitted on different types of works (collective, commissioned, edition...), the requirements of fair compensation for private copying, or the legitimacy of collective management organisations to act in court. Occasionally, some Provincial Courts face different issues, such as the scope of creative commons and similar licenses, or the new configuration of the resale right as mandatory collective management.
