Abstract

Collective bargaining is configured as one of the best ways to fight against discrimination and damage to privacy and intimacy caused by artificial intelligence systems in the framework of labour relations, given that it could address the use of digital technology, data collection and the application of labour algorithms, guaranteeing transparency, social sustainability and human control. In order to understand its potential, the spaces left for its development by the Workers’ Statute, the RGPD, the AI Regulation or the Platforms Directive are examined, and examples of good conventional practices in Spain and in other countries are offered.
