Abstract

The existence of injuries resulting from medical malpractice entitles the patient to claim compensation for the damage caused. With this claim, the plaintiff can request a first copy of his medical records free of charge. By referring to Articles 12.5, 15.1, 15.3 and 15.4 of the General Data Protection Regulation, it is determined that this right translates into an obligation for the healthcare professional to provide a first copy of the medical record free of charge, regardless of the purpose pursued by the patient. Furthermore, this copy must contain complete and intelligible information on the patient’s clinical process.
