Resumen

The Spanish insolvency system has undergone a profound modification as a result of the entry into force of Law 16/2022, which incorporates Directive (EU) 2019/1023 on preventive restructuring frameworks (Directive on restructuring and insolvency) into our legal system. The objective of this work is the study and assessment of the new pre-bankruptcy instruments introduced by the Reform, aimed at achieving agreements between viable companies and their creditors in an early phase of financial difficulties. We will focus our attention on the analysis of what, without a doubt, is the main incorporation of the Reform: the restructuring plans, conceived as an instrument to avoid insolvency and, with it, the feared judicial phase.
